These Terms of Service ("Terms") form a binding legal agreement between you ("you," "your," or "Customer") and Renew BKK LLC, an Arizona limited liability company ("Renew BKK," "we," "us," or "our"). These Terms govern your access to and use of www.renewbkk.com (the "Site"), the Renew BKK travel planning service, and any related products, features, content, and services we offer (collectively, the "Service").
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING A BINDING ARBITRATION AGREEMENT, A CLASS ACTION WAIVER, A LIMITATION OF LIABILITY, AND AN INDEMNIFICATION OBLIGATION. BY USING THE SERVICE, YOU AGREE TO THESE TERMS.
If you do not agree to these Terms, you must not access or use the Service.
1. About the Service: what Renew BKK is and is not
1.1 What we are
Renew BKK is a travel planning service. We produce written, personalized trip plans for travelers visiting Bangkok, Thailand. Our trip plans contain general travel suggestions including neighborhoods, lodging options, restaurants, activities, and (where you indicate interest) the names of clinics, spas, and other lifestyle businesses you may wish to research and contact directly. We may, with your consent, make warm introductions by email between you and a clinic, spa, hotel, or other partner.
1.2 What we are not
Renew BKK is not a travel agency, a tour operator, a healthcare provider, a medical referral service, a medical broker, a medical tourism facilitator, a travel insurance provider, a transportation provider, a lodging provider, a clinic, a hospital, or a licensed medical, dental, or wellness practitioner. We do not:
- book, reserve, or pay for any travel, lodging, transportation, dining, activity, clinic, spa, hotel, or other service on your behalf;
- bundle, package, sell, resell, or hold inventory of any travel or wellness services;
- provide medical, psychological, dental, nutritional, fitness, or any other professional advice;
- diagnose, treat, cure, prevent, or assess any health condition;
- recommend, prescribe, sell, supply, or arrange supply of any drug, peptide, hormone, supplement, medical device, or treatment;
- evaluate, supervise, or otherwise control the conduct, qualifications, licensing, services, products, prices, or outcomes of any third party we may mention or introduce.
1.3 You contract directly with all third parties
All bookings, payments, and contractual relationships for travel, lodging, transportation, dining, activities, clinics, spas, hotels, and other services occur directly between you and the third-party provider. We are not a party to those transactions, do not act as your agent, and do not act as the third party's agent for purposes of binding either side. You are solely responsible for evaluating, contracting with, paying, and managing your relationship with every third party you choose to engage.
1.4 No medical relationship or advice
Nothing in the Service constitutes medical advice, a medical opinion, a medical evaluation, a diagnosis, a treatment recommendation, or a substitute for consultation with a licensed physician or other qualified healthcare professional. Travel for wellness or other purposes carries inherent risks. You should consult your own licensed healthcare provider before, during, and after any trip, and before engaging any clinic, treatment, or wellness service. Any decision to engage any clinic or to undergo any treatment is made by you in consultation with the licensed providers at that clinic, and is your sole responsibility.
If you are experiencing a medical emergency, call your local emergency services immediately. Do not rely on Renew BKK or any communication with Renew BKK for urgent or emergent medical needs.
2. Eligibility
To use the Service, you must:
- be at least 18 years of age;
- have the legal capacity to enter into a binding contract;
- be a resident of the United States or Australia;
- not be barred from receiving services under the laws of any applicable jurisdiction;
- provide accurate, current, and complete information when requested.
By using the Service, you represent and warrant that each of the above is true. The Service is not offered to and may not be used by anyone under 18, by individuals outside the United States and Australia, or by anyone whose use would violate applicable law.
3. Description of the Service tiers
We currently offer the following tiers. Pricing, scope, and availability may change. The Service tier you receive is the one in effect at the time of your purchase or intake submission, as confirmed in writing.
3.1 Free Plan
You complete an intake form. We send you a written, personalized trip plan in PDF format by email, generally within 24 to 72 hours of submission. The Free Plan is delivered at no cost to you.
3.2 Concierge Call ($189 USD)
A 30-minute scheduled video or voice call with a Renew BKK representative to discuss and refine your trip plan, plus, where you request it, a warm email introduction to a clinic, spa, or other partner.
3.3 Trip Companion ($249 USD)
Includes the Concierge Call, plus live messaging support during your trip via WhatsApp during stated business hours (Monday through Saturday, 9:00 AM to 7:00 PM Bangkok time, subject to change), plus up to five (5) revisions to your trip plan delivered as updated PDFs within four (4) hours during business hours. Additional revisions are available at $49 USD each. Trip Companion service starts no earlier than seven (7) days before your stated arrival date in Bangkok and ends no later than the date of your stated departure.
3.4 What is not included in any tier
Unless we expressly state otherwise in writing, no tier includes: actual travel bookings; actual payments to third parties; presence in Bangkok with you; emergency assistance; medical assistance; legal assistance; financial assistance; visa or immigration assistance; travel insurance; or any guarantee of availability, quality, or outcome with respect to any clinic, hotel, restaurant, or other third party.
4. Vetting standards and clinic introductions
4.1 What "vetted" means
Where we describe a clinic, hotel, or partner as "vetted" or use similar language, we mean that we have done one or more of the following: reviewed publicly available customer reviews, spoken with or visited staff at the location, and reviewed information provided by the partner. Vetting is informal, non-exhaustive, and based on our subjective judgment. It is not an audit, accreditation, license verification, medical credentialing review, malpractice review, or guarantee of any kind.
4.2 We do not endorse outcomes
We make no representation or warranty regarding the licensure, accreditation, training, qualifications, malpractice history, financial stability, ethics, conduct, prices, treatment quality, products, results, or safety of any clinic or partner. You are solely responsible for independently verifying every aspect of any clinic or partner before engaging them, including their license status, credentials, the qualifications of any practitioner who treats you, the quality and provenance of any product or treatment, and the suitability of any service for your specific situation.
4.3 Warm introductions
If you ask us to make a warm introduction to a clinic, hotel, spa, or other partner, the information we share with the partner depends on the consent you gave on our intake form. By default, we share only your first name and email address. If you checked the partner-sharing consent box on the intake form, we may share the relevant categories of information you provided in that form, including travel dates, length of stay, wellness interest categories, and any specific questions or notes you wrote into the form, as described in Section 6 of our Privacy Policy. You may withdraw consent for future sharing at any time by emailing privacy@renewbkk.com. Once an introduction is made, all communications, scheduling, payment, treatment, and follow-up occur directly between you and the partner, and the partner becomes an independent controller of any information we transmit. We are not a party to that relationship and have no role in any clinical, contractual, or commercial decision made within it.
4.4 Affiliate and referral compensation (material disclosure)
You should be aware that Renew BKK has financial relationships with some of the clinics, hotels, spas, and other businesses we may mention or introduce you to. We may receive an affiliate commission, referral fee, listing fee, or other compensation if you book or purchase services from those partners after we introduce you. Compensation does not change the price you pay. We disclose these relationships in our Privacy Policy, in marked sections of our trip plans, and at the time of warm introductions where required by applicable law including the U.S. Federal Trade Commission's Endorsement Guides.
4.5 No exclusivity, no guarantee of availability
We do not guarantee that any specific partner will be available, will respond to an introduction, will accept you as a customer, will offer any specific service or price, or will perform to any standard. Partners may decline introductions for any reason. We may discontinue any partner relationship at any time.
5. Acknowledgment and assumption of risk
By using the Service, you knowingly and voluntarily acknowledge and agree to the following:
5.1 Travel risk
International travel, including travel to Bangkok and within Thailand, involves inherent risks, including but not limited to: travel delays and cancellations; lost luggage; theft; injury; illness; infectious disease; food and waterborne illness; accidents; traffic and transportation incidents; natural disasters; political unrest; civil disturbance; criminal activity; terrorism; war; differences in legal systems and consumer protections; differences in medical and emergency response infrastructure; and language and cultural barriers. You assume all risks associated with your decision to travel.
5.2 Wellness, clinic, and treatment risk
Wellness services, clinic visits, treatments, procedures, supplements, and similar engagements involve inherent risks, including but not limited to: adverse reactions; complications; injury; permanent harm; treatment failure; misdiagnosis; malpractice; products of inconsistent quality, provenance, or labeling; and outcomes that differ from your expectations. Standards of practice, licensure, oversight, malpractice law, and consumer protection vary by country and by provider. You assume all risks associated with your decision to engage any clinic, practitioner, product, or treatment, whether or not Renew BKK introduced you.
5.3 Information limitations
The Service consists of general suggestions and is not tailored to your specific medical, legal, financial, or personal circumstances. Information may be incomplete, outdated, or inaccurate. Prices, hours, availability, ownership, quality, and other details of third parties change frequently and without notice to us. You are responsible for independently verifying all information before relying on it.
5.4 Assumption of risk
To the fullest extent permitted by applicable law, you knowingly assume all risks of any kind associated with your use of the Service, your travel, and any engagement with any third party we mention or introduce, whether or not those risks are foreseeable.
6. Disclaimers
6.1 As-is
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENEW BKK DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, COMPLETENESS, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
6.2 No warranty regarding third parties
WE MAKE NO WARRANTY OR REPRESENTATION OF ANY KIND REGARDING ANY THIRD PARTY that may be referenced, recommended, or introduced through the Service, including but not limited to clinics, practitioners, hospitals, hotels, spas, restaurants, transportation providers, tour operators, booking platforms, payment processors, and other businesses. We do not endorse, sponsor, control, or assume responsibility for any product, service, content, conduct, or omission of any third party.
6.3 No warranty of accuracy, completeness, or results
We do not warrant that the Service or any content provided through it is accurate, complete, current, reliable, error-free, uninterrupted, or secure. We do not warrant that you will achieve any particular result, outcome, or benefit from your trip or from any third party we mention or introduce.
6.4 No medical, legal, or financial advice
The Service does not provide medical, legal, tax, financial, insurance, or other professional advice. Information in the Service is for general informational and lifestyle purposes only.
6.5 Some warranties cannot be disclaimed
Some jurisdictions do not allow the exclusion of certain warranties. To the extent any warranty cannot be disclaimed under applicable law, the duration and scope of that warranty are limited to the minimum permitted by law. Australian Consumers may have rights under the Australian Consumer Law that cannot be excluded. Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable Australian Consumer Law right.
7. Limitation of liability
7.1 Cap on liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RENEW BKK, ITS AFFILIATES, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE TO YOU FOR ANY DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, ANY THIRD PARTY, OR YOUR TRIP, IN AN AGGREGATE AMOUNT EXCEEDING THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO RENEW BKK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).
7.2 Exclusion of indirect damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RENEW BKK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, USE, OR ENJOYMENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.3 Specific exclusions
WITHOUT LIMITING THE FOREGOING, RENEW BKK IS NOT LIABLE FOR:
- any personal injury, illness, disability, emotional distress, or death suffered by you or any travel companion;
- any medical complication, adverse reaction, malpractice, misdiagnosis, treatment failure, or product defect caused by any clinic, practitioner, product, or treatment, whether or not introduced through the Service;
- any property loss, theft, damage, or destruction;
- any failure, delay, cancellation, error, or omission by any third party, including any clinic, hotel, airline, transportation provider, tour operator, booking platform, restaurant, or partner;
- any inaccurate, outdated, or incomplete information about any third party, neighborhood, route, price, or service;
- any unauthorized access to or alteration of your data despite our reasonable security measures;
- any data, communications, or actions of any partner after we make a warm introduction;
- any loss caused by your reliance on a recommendation, suggestion, or introduction;
- force majeure events as described in Section 13.
7.4 Basis of the bargain
You acknowledge that the disclaimers in Section 6 and the limitations in this Section 7 are a fundamental basis of the bargain between you and Renew BKK, that we would not provide the Service without these limitations, and that the limitations apply even if any limited remedy is found to fail of its essential purpose.
7.5 Some limitations may not apply
Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, or for personal injury, so some of the above limitations may not apply to you in their entirety. Where applicable law does not allow exclusion of certain liabilities, our liability is limited to the minimum permitted by law.
8. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Renew BKK, its affiliates, officers, members, employees, contractors, and agents (each, an "Indemnified Party") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and disbursements) arising out of or relating to:
- your access to or use of the Service;
- your breach of these Terms;
- your violation of any applicable law or any rights of any third party;
- any information or content you submit, post, or transmit through the Service;
- your engagement with, conduct toward, or relationship with any third party we mention or introduce, including any clinic, practitioner, hotel, or partner;
- your travel, including any injury, illness, complication, or loss you or any travel companion suffers;
- any treatment, procedure, product, supplement, or service you receive or purchase from any clinic, practitioner, or partner;
- any misrepresentation by you in connection with the Service.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. You will not settle any matter without our prior written consent.
9. Payment, refunds, and cancellations (paid tiers only)
9.1 Pricing and payment
Prices for paid tiers are listed on the Site or quoted to you at the time of order, in U.S. dollars unless otherwise stated. Payment is processed by our third-party payment processor. By providing payment information, you authorize us and our payment processor to charge the applicable amount.
9.2 Refund policy
Because the Service is delivered as labor and bespoke written work product, our refund policy is as follows:
Concierge Call ($189):
- A full refund is available if you cancel in writing more than 48 hours before the scheduled call.
- A 50 percent refund is available if you cancel in writing between 24 and 48 hours before the scheduled call.
- No refund is available if you cancel less than 24 hours before the scheduled call, fail to attend the call, or after the call has occurred.
Trip Companion ($249):
- A full refund is available if you cancel in writing before any Concierge Call has occurred and before any messaging support or revision has been delivered.
- A 50 percent refund is available if the Concierge Call has occurred but no in-trip messaging support or revision has yet been delivered.
- No refund is available once in-trip messaging support has begun, after any revision has been delivered, or after your stated trip dates have begun.
Additional revisions ($49 each): Non-refundable once requested.
9.3 Chargebacks
If you initiate a chargeback or payment dispute that we determine in good faith to be inconsistent with this Section 9 and these Terms, you authorize us to dispute the chargeback with the payment processor and you remain liable for the disputed amount, plus any fees we incur. We reserve the right to refuse future service to any user who initiates an unjustified chargeback.
9.4 Taxes
You are responsible for any sales, use, value-added, or other taxes that apply to your purchase, except for taxes based on our income.
9.5 No price guarantee for third parties
Prices we mention for any third-party service are estimates only and may be inaccurate or outdated. The actual price you pay any third party is set by that third party and is not within our control.
10. Your conduct and content
10.1 Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- impersonate any person or misrepresent your identity, age, or affiliation;
- submit false, misleading, or stolen information;
- attempt to access, scrape, harvest, or interfere with any portion of the Service or our systems without authorization;
- introduce malware or attempt to disrupt the Service;
- reverse engineer, copy, modify, distribute, or create derivative works of the Service except as expressly permitted;
- use the Service to harass, threaten, or abuse anyone, including any partner;
- use the Service in any manner that could damage, disable, overburden, or impair the Service.
10.2 Your content
You retain ownership of any content you submit to us through the Service ("Customer Content"). By submitting Customer Content, you grant Renew BKK a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, copy, store, process, transmit, modify, and display Customer Content for the purposes of operating, providing, improving, and marketing the Service. You represent and warrant that you have all rights necessary to grant this license.
10.3 Feedback
Any feedback, suggestions, ideas, reviews, or testimonials you provide may be used by us without restriction or compensation to you. We may publish reviews and testimonials on the Site, in advertising, or in other marketing materials, attributed by first name and last initial only unless you separately agree otherwise.
11. Intellectual property
The Service, including the Site, trip plan templates, written content, designs, logos, the "Renew BKK" name, and all related materials, is owned by Renew BKK or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes consistent with these Terms. The trip plan we deliver to you is for your personal use only; you may not republish, sell, or commercially exploit it. All rights not expressly granted are reserved.
12. Communications and marketing
By submitting your email address, you consent to receive transactional emails related to your use of the Service. If you opt in, you also consent to receive marketing emails from Renew BKK. You may unsubscribe from marketing emails at any time using the link in any marketing email or by contacting us at privacy@renewbkk.com. Transactional emails are not subject to opt-out so long as you are an active customer.
If you provide a phone number and consent to messaging, you consent to receive WhatsApp or SMS messages relating to the Service. Standard message and data rates from your carrier may apply.
13. Force majeure
Renew BKK is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics or epidemics (including ongoing or future outbreaks), war, terrorism, civil unrest, government actions or restrictions, embargoes, labor disputes, supply chain failures, internet or telecommunications failures, third-party service outages, or any similar event.
14. Term, termination, and survival
These Terms remain in effect for as long as you access or use the Service. We may suspend or terminate your access at any time, with or without notice, for any reason, including any actual or suspected violation of these Terms. You may stop using the Service at any time. The provisions of these Terms that by their nature should survive termination will survive, including without limitation Sections 1, 4.4, 5, 6, 7, 8, 10.2, 10.3, 11, 15, 16, and 17.
15. Dispute resolution: binding arbitration and class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH RENEW BKK ON AN INDIVIDUAL BASIS AND LIMITS THE WAYS YOU CAN SEEK RELIEF FROM US.
15.1 Informal dispute resolution
Before bringing any formal claim, you agree to first contact us in writing at legal@renewbkk.com with a detailed description of the dispute, the relief you seek, and your contact information, and to attempt in good faith to resolve the dispute informally for at least 60 days.
15.2 Binding arbitration
If we cannot resolve the dispute informally, you and Renew BKK agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and Renew BKK, will be resolved exclusively through final, binding arbitration, except as set out below. The arbitration will be administered by JAMS in accordance with the JAMS Comprehensive Arbitration Rules and Procedures, or the JAMS Streamlined Arbitration Rules and Procedures for claims of $250,000 or less. The arbitration will be conducted in English, in Maricopa County, Arizona, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
15.3 Class action waiver
YOU AND RENEW BKK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims of more than one person or preside over any form of representative or class proceeding. If this class action waiver is held to be unenforceable, the arbitration agreement in Section 15.2 will be void, and the dispute will instead proceed in court under Section 15.5.
15.4 Exceptions
Notwithstanding the above, either party may: (a) bring an individual claim in small claims court if eligible; (b) seek injunctive or other equitable relief in court to protect intellectual property rights; (c) where required by applicable consumer law (including the Australian Consumer Law), pursue remedies that cannot be excluded.
15.5 Jury and forum waiver if arbitration is unenforceable
If for any reason a claim proceeds in court rather than arbitration, you and Renew BKK each waive any right to a jury trial. You and Renew BKK consent to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona for any such action, and you waive any objection based on inconvenient forum.
15.6 30-day right to opt out of arbitration
You may opt out of Sections 15.2 and 15.3 by sending written notice to legal@renewbkk.com within 30 days of first agreeing to these Terms. Your notice must include your full name, the email address used to access the Service, and a clear statement that you are opting out of arbitration. Opting out will not affect any other provisions of these Terms.
16. Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Arizona, United States, without regard to its conflict of laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 15. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are an Australian Consumer, nothing in this Section limits any non-excludable rights you have under the Australian Consumer Law, and the laws of your state or territory of residence may apply to those non-excludable rights.
17. General
17.1 Entire agreement
These Terms, together with our Privacy Policy and any other policies referenced here or accepted at purchase, constitute the entire agreement between you and Renew BKK regarding the Service and supersede all prior agreements and understandings.
17.2 No waiver
Our failure to enforce any provision is not a waiver of that provision. No waiver is effective unless in writing and signed by us.
17.3 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
17.4 Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms at any time without notice, including in connection with a merger, acquisition, or sale of assets.
17.5 No agency or partnership
Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Renew BKK.
17.6 Notices
We may give you notice through the Site, by email to the address you provided, or by any other lawful means. You may give us notice at legal@renewbkk.com.
17.7 Updates to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent version. For material changes, we will provide reasonable notice. Your continued use of the Service after the effective date constitutes acceptance.
